Clarification Text on the Protection of Personal Data

Egeli&Co. Yatırım Holding A.Ş. holds the title of "data controller" within the scope of Law No. 6698 on the Protection of Personal Data regarding the personal data of users of the Egeli&Co. Yatırım Holding A.Ş. website. With this Clarification Text, our users are informed in accordance with the relevant law and regulations.

Purpose of Processing Personal Data:

Personal data belonging to users are processed for the following purposes: carrying out necessary operations by the business units and executing relevant business processes to enable users to benefit from the products and services offered by Egeli&Co. Yatırım Holding A.Ş.; conducting necessary operations by relevant business units and executing related business processes to facilitate the commercial activities of Egeli&Co. Yatırım Holding A.Ş.; planning and executing Egeli&Co. Yatırım Holding A.Ş.'s commercial and/or business strategies.

Transfer of Personal Data

Personal data may be transferred within the framework of the personal data processing conditions and purposes specified in Articles 8 and 9 of Law No. 6698. This includes the planning and execution of activities necessary to recommend and promote the products and services offered by Egeli&Co. Yatırım Holding A.Ş. by customizing them according to users' tastes, usage habits, and needs. Personal data may be shared with company officials, our business partners, legally authorized public institutions, organizations, and private entities.

User Consent on the Matter

In cases listed in paragraph 2 of Article 5 of Law No. 6698, personal data may be processed without explicit consent from users. These cases include:

  • If explicitly stipulated in the laws,
  • If necessary to protect the life or physical integrity of a person who is unable to express consent due to actual impossibility or whose consent is legally invalid,
  • If it is necessary to process personal data belonging to the parties to a contract, provided that it is directly related to the establishment or performance of the contract,
  • If mandatory for the data controller to fulfill its legal obligations,
  • If the data subject has made the data public,
  • If data processing is necessary for the establishment, exercise, or protection of a right,
  • If data processing is mandatory for the legitimate interests of the data controller, provided that it does not violate the fundamental rights and freedoms of the data subject.

The service that users receive under the Egeli&Co. Yatırım Holding A.Ş. membership agreement falls under paragraph 2/c of Article 5 of Law No. 6698.

Method of Collection and Legal Basis for Personal Data:

Personal data is collected electronically from users. The collected personal data, based on the legal grounds mentioned above, may be processed and transferred for the purposes specified in Articles 5 and 6 of the Law and this Clarification Text.

User Rights as Personal Data Owners:

Pursuant to Article 11 of Law No. 6698, data owners have the right to:

  • Learn whether personal data about them is being processed,
  • Request information if their personal data has been processed,
  • Learn the purpose of processing personal data and whether they are used for their intended purpose,
  • Know the third parties to whom personal data has been transferred domestically or abroad,
  • Request correction of personal data in case of incomplete or incorrect processing and request notification of such correction to third parties to whom the data has been transferred,
  • Request the deletion or destruction of personal data, even if it has been processed in compliance with the Law and other relevant legislation, if the reasons for processing no longer exist, and request notification of this process to third parties to whom the data has been transferred,
  • Object to results arising to their detriment from the analysis of processed data exclusively through automated systems,
  • Demand compensation for damages in case of unlawful processing of personal data.
